California's hospice license moratorium: plan for mid-2027
The moratorium began with SB 664 (2021), was extended by AB 177, and was always tied to CDPH producing an actual regulatory framework — which now exists in the emergency regulations effective June 22, 2026. The statutory end-date formula ("January 1, 2027, or one year after adoption, whichever is sooner") reads on its face as pointing to January 1, 2027, since one year after a June 2026 adoption would be later. But statutory interpretation around emergency-versus-permanent adoption has enough ambiguity that anyone planning a licensure application, an acquisition priced on future licensure, or a geographic expansion should get the controlling date in writing from counsel — not from a blog, including this one.
What is not ambiguous: when licensure reopens, applicants will face the new emergency-regulation regime — management qualification requirements, staffing ratios, ownership disclosure, and demonstrated-need review for service areas — rather than the thin pre-2022 process. The era of the quickly obtained, quickly flipped California hospice license is over by design.
What to do now
- If entering or expanding in California hospice is in your plan, spend the moratorium runway building the compliance infrastructure the new regime requires. Applications that arrive ready under the new rules will move; applications built on 2021 assumptions will not.
