These Terms of Use (the "Terms") govern your use of americanhealthcarehub.com (the "Hub") and its content, operated by Flex Stream, Inc. ("Flex Stream," "we," "us"), a California corporation. Use of the CareOnboard platform at staff.americanhealthcarehub.com (the "Platform") is additionally governed by your agency's service agreement, including any Business Associate Agreement; if those documents conflict with these Terms, the service agreement controls for Platform use.
By accessing the Hub, subscribing to alerts, or purchasing a subscription, you accept these Terms on your own behalf and, where applicable, on behalf of the agency you represent.
News articles, alerts, and guides summarize regulatory developments from sources we monitor (CMS, CDPH, CDSS, ACHC, and others). They are informational only and are not legal, clinical, or billing advice. Regulations change; while we date each alert and name its official source, you are responsible for verifying requirements against the primary source and your own counsel before acting. No affiliation with or endorsement by any agency or accreditor is implied.
The Hub Assistant is an automated AI chat, not a person. Its answers are general information about the Hub, may be incomplete or wrong, and are not legal, clinical, billing or insurance advice. Prices, plan terms and policies are those published on our pricing page and in these Terms; if a chat answer differs, the published terms control. Chat messages are processed by our AI provider and stored as described in our Privacy Policy.
Policy templates, forms, and other library documents are licensed, not sold. A paid subscription grants the subscribing agency a non-exclusive, non-transferable license to download, adapt, and use current versions of library documents for its own internal operations at the locations covered by its subscription, within the limits in this section. Library documents may not be resold, redistributed, published, or shared outside the subscribing agency. Templates require adoption and review by your agency before use; they are starting points, not a guarantee of survey or audit outcomes.
Official government forms and publications. Official government forms and publications in the library (for example, the CMS ABN, HHCCN, NOMNC and DENC notices, Form I-9, IRS Form W-4, EDD Form DE 4 and the EDD pamphlets, the CMS Medicare booklets, and the California POLST form) are provided as the issuing agency publishes them. The one exception is the California Advance Health Care Directive, which is our typeset copy of the statutory form in Probate Code §4701, word for word; we added only a page header, page numbers and an optional notary acknowledgment page at the end. Fill in or customize these forms only as the issuing agency's instructions allow. Works of the United States Government are not subject to copyright (17 U.S.C. §105). This license does not cover official government forms and publications, and we claim no ownership of them.
Wording set by law. Some library documents contain passages whose exact words are prescribed by a statute, a regulation or a government agency, such as a statutory form or a required notice. When your agency adapts a document, keep those passages word for word, filling in only the blanks they contain.
Using documents in your operations. Your agency may give blank or completed library documents to the people and organizations it deals with in the course of its own operations: for example, its patients and their representatives; job applicants, employees, volunteers and contractors; the physicians, other practitioners and facilities involved in a patient's care; the businesses it contracts with; and surveyors, accreditors and payers. It may also give them to anyone the law requires it to give its records to. Doing so is not redistribution or sharing outside the subscribing agency. Reselling or republishing library documents, or giving them to another agency or business to use as its own forms, remains prohibited.
Completed records. Completed copies of a library document that are already in your agency's records (patient and personnel records, signed agreements and other completed forms) remain your agency's records after we update that document, after we withdraw it from the library, and after your subscription ends, and this license continues to cover keeping and using them in those records. For new use, download the current version; once we withdraw a document, this license no longer covers starting new records with it.
You are responsible for the accuracy of the information you provide and for keeping account credentials secure. Paid plans are billed per agency, monthly in advance, and renew automatically each month until canceled. You can cancel online at any time (Alerts & Library in My Hub under My subscriptions; CareOnboard plans and the Combo Pack under Billing & plan in the CareOnboard console) or by emailing hello@americanhealthcarehub.com; cancellation takes effect at the end of the current billing period and you will not be charged again. We will email the billing contact at least 30 days before any price increase takes effect. Rate locks are honored for their stated period. We may suspend accounts for non-payment or material breach with notice.
You agree not to misuse the Hub or Platform: no unauthorized access or scraping of subscriber-only content, no interference with the service, no use that violates law, and no submitting information you lack the right to submit.
The Hub, Platform, library, and all associated content and marks are owned by Flex Stream or its licensors, except the official government forms and publications described in Section 3, which we do not own. Except for the library license above and personal, non-commercial reading of free content, no rights are granted.
The Hub and its content are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Flex Stream's aggregate liability arising out of the Hub or these Terms is limited to the amounts you paid us in the twelve months before the claim, and neither party is liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by California law; venue lies in the state and federal courts of Los Angeles County, California. We may update these Terms. We will post the revised Terms on this page with a new "Last updated" date and, for material changes, email the account's billing contact at least 30 days before they take effect. Changes apply only going forward and do not apply to disputes that arose before they took effect. If you do not agree to a change, you may cancel your subscription before it takes effect.
