CMS freezes new home health and hospice Medicare enrollment nationwide

Effective May 13, 2026, CMS imposed a six-month nationwide moratorium on new Medicare enrollments for home health agencies and hospices — and on certain majority ownership changes requiring re-enrollment. Currently enrolled providers are unaffected, but the surrounding enforcement posture touches everyone.

CMS describes the moratorium as a data-driven fraud-prevention measure aimed at the enrollment channel that has fed much of the documented fraud in both sectors. It follows a similar action against DMEPOS suppliers earlier in the year and arrives alongside a broader federal enforcement build-out targeting home-based care.

What it covers: new Medicare enrollment applications for home health agencies and hospices nationwide, plus certain majority ownership changes that trigger re-enrollment. What it doesn't: providers already enrolled, which continue operating and billing normally.

Three practical implications even if you're safely enrolled:

Transactions are affected. If you're buying, selling, or restructuring, any change of majority ownership that requires re-enrollment may be caught by the freeze. Deal timelines that assumed routine enrollment processing need re-examination — and note that in California, hospice transactions face a separate, stricter state-level CHOW regime under the new CDPH emergency regulations. The two clocks are independent.

Oversight is elevated for everyone. CMS paired the moratorium with increased enforcement and oversight activity. Expect more data-driven targeting (the hospice SSVI published with the FY 2027 proposed rule is one visible instrument), more medical review, and — in enhanced-oversight states — accreditor focus surveys between regular cycles.

The competitive map shifts. With new entry frozen for six months, existing licensed and enrolled agencies hold their positions. For compliant operators, this is a window in which the value of your enrollment and license quietly increases — and in which demonstrating clean operations differentiates you with referral sources watching the enforcement headlines.

What to do now

  • If any ownership or structural change is contemplated in the next two quarters, get regulatory counsel on whether it triggers re-enrollment before signing anything.
  • Keep your enrollment file (PECOS), ownership disclosures, and state license records perfectly aligned — mismatches are the cheapest finding for a data-driven review to surface.
  • If you operate in a state under enhanced oversight, prepare for the possibility of a short-notice focus survey.
